Payment, Cancellation, Availability

Once a booking of art classes, or an art camp, or a party, or an art show, or a workshop, or a museum guided tour has been made, we will try our best to alter it if need be. In the event of a deposit being made, all deposits are non-refundable. If full payment is made, this is non-refundable. Should an event for any reason be cancelled by Cherry Art School, we will issue a full refund of the cost of the booking only. All advertised events and birthday party packages are subject to availability.

PLEASE NOTE: if your child has any special needs, please let us know before booking. If a student has an SNA at school, we ask that the student has the SNA attending the art classes / art camps with them all the time.

COVID-19

If an event is cancelled by Cherry Art School due to the COVID-19 pandemic, we will reschedule to another date up to three times. If the customer requests a refund after the event has been rescheduled three times and has not gone ahead due to COVID-19, we will offer a refund minus an admin fee of €10.

Do not attend if feeling unwell or displaying symptoms.

Do not attend if someone in your household is likewise feeling unwell, or self isolating.

Cherry Art School Liability

In any event Cherry Art School shall not be liable for death or personal injury suffered by the client or its guests arising out of the booking. This limitation of liability shall also extend to any loss or damage sustained by property or belongings of the client or any of the client’s guests or for any further costs, demands or expenses incurred or suffered by the client arising out of the booking.Or for any loss or damage to the client arising out of circumstances including but not limited to any act of God, natural disaster or act of terrorism. Cherry Art School will not be liable for any cancellation of or alteration to the booking. If the COVID-19 crisis or another epidemic/ pandemic means events must be cancelled we will offer a rescheduling up to three times and we will offer you a voucher. As a small business we will be unable to offer refunds.

Your obligations to Cherry Art School are simply to cooperate with them and provide any information required by them to enable them to do their job properly. Nothing in these Terms and Conditions shall affect your statutory rights as a Consumer. All prices are as per the order form or written quote. Payment shall be in the manner specified in the order form or written quote. The payment paid by you is non refundable.

Registrations are processed on a first-come, first-served basis. Payment We require full payment at the time of registration via credit card.

The below information is relevant for all of our services (including but not limited to camps, after school art classes, art shows, workshops, art exhibitions, parties, corporate events, family events & festivals, museum guided tours): We require written notice if you need to withdraw from a camp, please send an email to julia@cherryart.ie requesting the withdrawal. We do not offer refunds, but will reschedule your child /event to the best of our ability. 

Cancellation Policy

Cherry Art School reserves the right to cancel a session due to insufficient enrollment. In that event that the session is cancelled, your payment will be refunded in full. Camp Hours and Admission to the Camp hours are as follows: Full-day Camp: 10:00 a.m. to 2:00p.m. Drop-off and pick-up will be at the entrance of the camp venue. Please drop-off and pick-up on time. An authorised adult must sign your child in and out of camp each day. Pick up time is considered to be late after the first 10 minutes of scheduled end time of each camp day. Late pick up will be charged at €5 per 5 minute interval or part thereof that the responsible adult is late until the child is picked up. There are no refunds for absences and there is no provision for make-up classes. Lunch Please make sure your child brings a nutritious bag lunch and a water bottle to camp every day. We are a nut-free art school. Please pack a lunch that is nut-free as we sometimes have campers that have life-threatening allergies. Health/Allergies If your child has special health needs or any allergies, please let us know on the registration form. Please let us know if your camper has special conditions we need to be aware of. 

Emergency Medical Release

In the event of injury or serious illness, I give permission for the Cherry ART School instructors to obtain first aid and/or medical treatment for my child. I understand that if my child needs to be transported to an emergency facility, that decision will be made by the emergency team responding to the call. 

Waiver and Release

Acknowledgement: I expressly acknowledge that there are certain dangers, risks, illnesses and personal injuries inherent in participating in the Cherry Art School programs, events, camps, classes, and/or other activities. Accidents, injuries, athletic activities, and/or my child’s or ward’s (“My Child”) own physical condition may result in harm to My Child. I understand that Cherry Art School and its employees, agents, counsellors, teachers, educators, trainers, volunteers, representatives, successors and assigns assume no responsibility for loss, damage, illness or injury to person or property that I or My Child, if applicable, may sustain as a result of my or their physical condition or resulting from my or their participation in any activities, programs, events, camps, classes, exhibitions, the use or non-use of any equipment, exercise, or any other activities, camps, classes, events or programs at and/or sponsored by Cherry Art School. 

I expressly acknowledge, on behalf of myself and My Child, jointly and severally, and any or all of our heirs and executors, that I voluntarily assume the sole risk of any and all dangers, illnesses and personal injuries that may result from My Child’s participation in any events/activities/programs/camps/classes/exhibitions while at Cherry Art School venues/or sponsored by Cherry Art School. I also acknowledge that Cherry Art School often uses photographs, videotapes, television programs, motion pictures, tape recordings, or other similar media for promotional purposes. I hereby consent to the use of My Child’s name and/or likeness in such materials to be exhibited and used for advertising, social media, trade purposes, solicitation of patronage, promotional purposes, or other similar purposes, even if my and/or My Child’s name and/or likeness are an integral part of such photograph videotape, television program, motion picture, tape recording, or other similar media. 

Release: In consideration of Cherry Art School allowing me and/or My Child to attend and/or participate in any programs, events, camps, classes, or other activities at Cherry Art School venues and/or sponsored by Cherry Art School, I, for myself, and My Child, jointly and severally, and all of our heirs, and executors, hereby waive, release and forever discharge Cherry Art School and its employees, agents, counselors, teachers, educators, trainers, volunteers, representatives, successors and assigns, from and against any and all rights and claims for any loss, damage, illness or injuries to person or property sustained as a result of my or My Child’s attendance and/or participation in any such programs, events, camps, classes, and other activities, whether or not such loss, damage or injury results from the negligence of Cherry Art School and its employees, agents, or representatives or from some other cause. My agreement to release Cherry Art School does not include any loss, damage or injury that results from Cherry Art School gross negligence or willful, wanton, or reckless misconduct. I further waive any and all rights to inspect or approve the photograph, videotape, television program, motion picture, tape recording or other use of my and/or My Child’s name and/or likeness, including any written article, script, caption or other writing that may accompany such use of my and/or My Child’s name and/or likeness. I hereby, for myself and My Child, jointly and severally, and any or all of our heirs, and executors, waive, release and forever discharge Cherry Art School and its employees, agents, counsellors, teachers, educators, trainers, volunteers, representatives, successors and assigns, from and against any and all liability, claims, losses, costs, expenses or damages for libel, slander, invasion of privacy, conversion, defamation, appropriation of likeness or any other claim based on the use of my and/or My Child’s name and/or likeness in any such materials.

Indemnification: I hereby represent and warrant to the Cherry Art School that I have the full authority to execute this Participant Waiver Form on behalf of myself and/or My Child, as parent, guardian and/or next friend, if applicable. In the event of any misrepresentation or breach of the foregoing warranty by me, or in the event that I, My Child, or any other person nevertheless asserts any claim against the Cherry Art School arising out of my or My Child’s participation in any program, event, class or other activity as set forth herein, I agree to indemnify, hold harmless and defend Cherry Art School from and against any and all liability, claims, losses, costs, expenses or damages, including reasonable attorneys’ fees, resulting therefrom, including, but not limited to, claims of loss, damage, illness or injury to person or property whether or not such loss, damage, illness or injury results from the negligence of Cherry Art School or from some other cause.

With respect we ask that you please do not attend a Cherry Art School event / art classes if you are experiencing any of the symptoms of COVID-19 (or any other pathogen that may arise as an epidemic or pandemic as defined by the WHO NSAI, HSA and HSE guidelines) as advised by the HSE. Please take responsibility for your movements, your child’s movements or any other person or child that you have with you and don’t put others in danger. Please note when entering our our camps, after school art classes or other events that we are following all of the latest NSAI, HSA and HSE guidelines to ensure our staff and customers are as safe as possible when undertaking activities here during the COVID-19 pandemic. We are also using these NSAI, HSA and HSE guidelines to ensure our birthday parties and corporate events, camps and school events are as safe as possible. If you book a Cherry Art School art class, art camp, workshop or other event please ensure that there is adequate space for safe social distancing in your home / venue. At our camps we will ensure that at our hired venues all of the NSAI, HSA and HSE guidelines are followed and we will have numbers of children safe for social distancing. Although we have adhered to all of the advice given we cannot ultimately guarantee that you will be entirely COVID-19 safe due to circumstances that may be beyond our control. It is each individual’s responsibility to play their part. Stay safe and healthy.
